Littleton Park obtained a defense verdict in a firearms product liability trial held in the United States District Court for the District of New Hampshire. The case arose out of a January 28, 2020 accidental discharge incident. Plaintiff was removing his pistol and holster from his belt when the pistol accidentally discharged a round into his right leg. Plaintiff alleged the pistol discharged without him pulling the trigger due to various manufacturing and design defects. The defense presented evidence showing that the subject pistol did not contain any manufacturing or design defects and that the only way it could have discharged was due to an inadvertent trigger pull as the pistol was being removed from its holster. The defense also presented evidence showing that the damage to Plaintiff’s holster confirmed the pistol was partially removed when it discharged, making the trigger fully accessible. After a week-long trial before the Hon. Landya McCafferty, the jury returned a unanimous defense verdict.
