NJ Senior Associate Jason Schmitz won summary judgment dismissing strict product liability and negligent maintenance claims against our client. The Court held that plaintiff's expert failed to sufficiently support the design or manufacturing claim and that our clients' installation contract limited the duty of care to a duty to repair and maintain the equipment, but that duty did not include the systematic repairs that plaintiff alleged our client should have performed.
