Michael H. Bai and Kristen E. Dennison obtained a defense verdict in the Court of Common Pleas, Jefferson County, Pennsylvania on behalf of DN Solutions America Corp., formerly known as Doosan Machine Tools America Corp. This commercial action arose out of a breach of warranty claim by Plaintiff Bear Manufacturing, LLC against DN Solutions America Corp. and its dealer alleging that two multi-axis mill turn centers were defective and that Defendants breached their warranties by failing to repair or replace the machines. Plaintiff sought damages for the value of the machines and lost profits in excess of $6.5 million. Prior to trial, DN Solutions America Corp. filed a motion for summary judgment. The Court partially granted DN Solutions America Corp.’s motion dismissing all consequential damages, including Plaintiff’s claim for lost profits. At trial, DN Solutions America Corp. presented evidence demonstrating that any time Plaintiff sought warranty repairs, DN Solutions America Corp. or its dealer repaired the subject machines. DN Solutions America Corp. also presented evidence that issues related to the subject machines were the result of a lack of trained operators and failure to maintain the machines. The jury returned a defense verdict finding that DN Solutions America Corp. did not breach any warranties. Charles Gilliam-Brownlee and Jackson Thomas also supported this trial effort.
