Jim Ughetta, Scott Toomey and Dan Kain Obtain Dismissal for Helmet Manufacturer

In Rosevear v. Trans National Trading Company, Inc. et. al., Jim Ughetta, Scott Toomey and Dan Kain obtained dismissal for one of the firm’s helmet manufacturer clients. In a detailed eleven-page opinion, the Superior Court of Floyd County, Georgia held that it lacked personal jurisdiction over Shanghai Tung Kuang Light Industry Co. Ltd. under Georgia’s long-arm statute and the Due Process Clause of the United States Constitution. The Court’s opinion held inter alia that “the placement of a product into the stream of commerce, without more, is not an act purposefully directed toward the forum state.”
