Dan Kain presented a sports litigation lecture at a recent Pennsylvania Defense Institute seminar held in Bethlehem, PA.  The lecture addressed current developments and litigation facing the sports industry.  Dan’s presentation focused primarily on procedural and substantive defenses available to manufacturers, schools, organizing bodies, teams and related entities involved in head injury and other sports based litigation.

In Rosevear v. Trans National Trading Company, Inc. et. al., Jim Ughetta, Scott Toomey and Dan Kain obtained dismissal for one of the firm’s helmet manufacturer clients. In a detailed eleven-page opinion, the Superior Court of Floyd County, Georgia held that it lacked personal jurisdiction over Shanghai Tung Kuang Light Industry Co. Ltd. under Georgia’s long-arm statute and the Due Process Clause of the United States Constitution. The Court’s opinion held inter alia that “the placement of a product into the stream of commerce, without more, is not an act purposefully directed toward the forum state."

In Kleinschmit v. U.S. Steel, et al., Scott Toomey and Dan Kain obtained a rare Philadelphia County summary judgment for one of the firm’s retailer clients. After lengthy and contested motion practice, the Court held that Plaintiff could not sustain his toxic tort benzene action because Plaintiff could not sufficiently identify the frequency, regularity and proximity of his exposure to any product associated with Littleton Joyce’s retailer client.
