December 19, 2008

After a distributor reported a product issue concerning our client's product to the CPSC, Bob Littleton negotiated with the CPSC to reconsider the CPSC's initial position that the product was a regulated "Consumer Product". Ultimately, the CPSC General Counsel's Office accepted the position we advocated in our briefing, reversed the Compliance Department's initial finding of jurisdiction, and determined that our client's product fell outside the CPSC's jurisdiction.

NYC partner Bob Littleton taught a session of Professor Carol Basri's Corporate Lawyering course at the University of Pennsylvania Law School. Bob spoke on Managing Corporate Crises, covering material from his chapter on this topic in Professor Basri's treatise.

NYC partner Michael Bai spoke on Product Liability Prevention and Concern at a legal seminar in Montreal, Canada presented by the Center for International Legal Studies. The audience included law professors and attorneys from Australia, Canada, Costa Rica, France, Germany and the United States.

Our Red Bank, NJ office moved into its permanent space in scenic Red Bank, NJ. We are the anchor tenant of a new office building in walking distance of the river and downtown. The office is readily accessible by car, New Jersey Transit Trains and high speed ferries from New York City.

In a result achieved by Jin Park and Michael Bai in concert with our local counsel Bobby Miller of Butler Snow in Mississippi, a trial court's grant of summary judgment to our client was affirmed by the Mississippi Court of Appeals. The Court found that the trial court was justified in holding that plaintiff expert's opinions concerning alleged defects in our client's forklift were not adequately supported. The trial court barred the expert and dismissed the case against our client. The Court of Appeals affirmed.

The seminar in New York City was presented by the American Bar Association, Practicing Law Institute and Asian American Bar Association. Mr. Littleton participated in a panel discussion with the Vice Presidents and General Counsel of Benjamin Moore & Co., The Dun & Bradstreet Corporation and others.
