Carmen J. Cole
Carmen J. Cole’s practice focuses on labor and employment, complex commercial, and product liability litigation.
She has extensive experience defending employers in litigation under state and federal anti-harassment and anti-discrimination statutes (FEHA, Title VII, ADEA, ADA), as well as defending against common law claims for wrongful termination, breach of contract, defamation, invasion of privacy, and other employment-related torts. Ms. Cole also represents employers in matters involving non-competition agreements and trade secret misappropriation.
Ms. Cole also provides advice and counseling to employers regarding daily workplace issues, including compliance with wage and hour laws, anti-discrimination and anti-harassment laws, record-keeping requirements, vacation, mandatory leave laws, and other human resources practices. She drafts policies and negotiates employment, and severance agreements on behalf of employers.
In addition to her labor and employment expertise, Ms. Cole has extensive experience handling a variety of commercial, business, and insurance matters, such as complex construction litigation, single plaintiff and class action litigation involving alleged unfair business practices and consumer protection claims, and first party bad faith actions on behalf of insurers. She has also represented employee benefit plans, plan administrators, and life, health, and disability insurers in litigation under the Employee Retirement Income Security Act (ERISA).
Ms. Cole practices in both state and federal court, as well as before various administrative agencies, such as the United States Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing, and the California Department of Industrial Relations – Division of Labor Standards Enforcement. She has handled numerous litigation matters through summary judgment, trial and appeal, as well as defending clients in binding arbitration. Ms. Cole has represented clients in the manufacturing, construction, retail, banking, aerospace, entertainment, and real estate industries, among others.
